Poland: Biomethane production - proposals to amend regulations

A team of experts from the Government Plenipotentiary for Rural Energy Transformation has prepared a comprehensive proposal to amend the law on biomethane generation in Poland.

The main points of the prepared legislative proposal include:

  • Introducing a legal definition of biomethane. Effective launch of the biomethane market in Poland requires defining basic legal concepts.
  • Introduction of instruments for operational support of biomethane production. Launch of a separate support instrument dedicated to the production of biomethane from different feedstocks and taking into account technical and economic considerations.
  • Integration of biomethane facilities with the gas grid.
  • Facilitating the investment and construction process. An important element enabling the development of biomethane installations are the procedures related to the investment and construction process for biomethane installations (including environmental decision, construction permit, and occupancy permit).
  • Use of biomethane to meet the National Indicative Target. Starting in 2023, the transportation sector faces the need to use so-called second-generation biofuels or to add so-called second-generation biocomponents of waste origin to liquid fuels. In order to maintain a competitive position in the Community market, it is crucial to ensure the possibility of using biocomponents of domestic production utilizing the domestic potential of the agri-food sector in this regard. Polish biomethane produced from biodegradable substrates of waste origin and in compliance with the principles of sustainable development responds to this demand.
