EU: new regulation on official controls on food, feed and animal welfare

With the publishing of this Regulation, Regulations (CE) 882/2004 and (CE) 854/2004 of the European Parliament and Counsel are abolished.

The Official Journal of the EU has published Regulation (EU) 2017/625 of the European Parliament and Counsel of March 15th 2017 regarding the controls and other official activities carried out to guarantee the application of the legislation on food and feed, and the guidelines on animal health and welfare, plant health and phytosanitary products (Regulation on oficial controls).

With the publishing of this Regulation, Regulations (CE) 882/2004 and (CE) 854/2004 of the European Parliament and Counsel; Directives 89/608/CEE, 89/662/CEE, 90/425/CEE, 91/ 496/CEE, 96/23/CE, 96/93/CE and 97/78/CE of the Counsel; and Decision 92/438/CEE of the Counsel, will be abolished as of December 14th 2019.

Regulation (CE) 882/2004 of the European Parliament and Counsel established a single legal framework for the organisation of the official controls, the implementation of the EU legislation regarding the agrifood chain and the level of protection against hazard for human and animal health, plant healt and the welfare of animals in the EU, as well as the level of protection of the environment against the hazards that could derive from the GMOs and the phytosanitary products. It has also served as a consolidated judicial framework for supporting an integrated focus destined to the carrying out of official controls along the agrifood chain.

The new Regulation aspires to establish a EU harmonised framework for the organisation of the official controls and the official activities different from the official controls along all the agrifood chain, bearing in mind the rules regarding official controls established in Regulation (CE) 882/2004 and in the applicable sectorial legislation acquired thanks to the implementation of the aforementioned norms.

This Regulation foresees the development, by the Commission, of more than 70 delegated and implementing acts with the aim of guaranteeing the organisation of the activities foreseen in it, and it will come into force 20 days after its publishing in the Official Journal of the EU.
